Some Social Security lawyers do not charge any fee unless you receive benefits. However, if the Social Security lawyer does charge a fee for his/her services, he/she must first file a fee agreement or fee petition with Social Security. You cannot be charged more than the fee amount approved by Social Security. However, a Social Security lawyer can charge you for out-of-pocket expenses without Social Security approval.

A Social Security lawyer who charges or collects an unapproved fee may be suspended or disqualified from representing anyone before the Social Security Administration and could also face criminal prosecution.
