Social Security Disability Case

A social security disability case is essentially an applicant's claim for benefits from either Social Security Disability or for Supplemental Security Insurance which has been turned down or denied for some reason and which the applicant has given to an attorney to access assistance in contesting the denial by reconsideration request, appealing the denial to the Appeals Council or an ALJ or by filing a complaint in a federal district court.

Fast Facts

  • Some cases must be presented with emphasis on different factors than cases that lend themselves to clear "medically acceptable" or objective, laboratory and clinical diagnostic techniques because the condition is hard to diagnose; Fibromyalgia and chronic fatigue syndrome are examples.
  • The main issue in a Social Security disability case is whether or not the applicant is able to work. Do not focus on the details of the medical condition but instead focus on the specific ways in which the ability to function has been limited by the condition.
