Drug & Alcohol Materiality

The issue of DAA (drug/alcohol abuse) materiality can appear in a number of different types of disability cases detailing a physical, psychiatric, or psychological disability caused by drug or alcohol use. Medical evidence indicating that either recent or ongoing drug and/or alcohol abuse caused or worsened the condition the claimant alleges as a disability is material to that disability claim if the disability is exacerbated or caused by drug or alcohol use.

Fast Facts

  • If an applicant has a physical impairment or mental condition for which he is filing and it can be shown that, minus the effects of his drug or alcohol use, the condition would not be disabling, the claim would likely be denied.
  • Drug and alcohol materiality is generally viewed as easy basis allowing the social security administration to deny disability claims.
