Disability Appeal

There is an administrative review process provided for an appeal of a decision by an administrative law judge denying an applicant disability benefits. If an applicant is dissatisfied with the initial determination denying him an entitlement to disability benefits he may request further information detailing the process required to obtaining an appeal of that decision. An applicant needs to be able to show in writing that his rights have been adversely affected by the initial determination Social Security determination denying his benefits. A claimant must first request that the initial determination be reconsidered, if the reconsideration is not favorable, the claimant may then request a hearing before an administrative Law Judge, and if that decision is also not favorable, the claimant can then request a review by appeal to the Appeals Council.
