Appeals

There is an administrative review process provided for an appeal of a decision by an administrative law judge concerning social security benefits if a claimant is dissatisfied with the initial determination concerning an entitlement to benefits or other matters. A claimant must request further information on obtaining an appeal of that decision if he disagrees with a Social security determination or if a claimant can show in writing that his rights have been adversely affected by the initial determination. A claimant must first request that the initial determination be reconsidered, if the reconsideration is not favorable, the claimant may next request a hearing before an administrative Law Judge, and if that decision is also not favorable, the claimant can then request a review by the Appeals Council.

  • A request for further review or appeal can be made by filling out a special form generated for that purpose and available at any Social Security Office or the request may be made by letter.
  • Any claimant dissatisfied with a decision of the Appeals Council may file a civil action in a Federal District Court
