Appeal Deadline

There are time limits imposed for requesting review in the Social Security review process. That time period is usually sixty days from receipt of the notice of the decision or determination of benefits. If the claimant or his legal representative does not request an appeal of the underlying order during that sixty day time period, unless a longer period is allowed for good cause, the determination of benefits becomes final and binding on the parties affected.

  • Even though a determination has become final, it may sometimes be reopened and revised by a SSA field office, DDS, reviewing office, ALJ or Appeals Council if certain conditions are met.
  • An extension of the time for requesting an appeal may be granted pursuant to a written request for reconsideration of the determination, a request for a Appeals Council review or pursuant to the filing of a suit addressing the issue in a federal District Court.
